These Terms & Conditions (“Terms”) govern the use of the website and services provided by The Certified Society LLC (“The Certified Society,” “we,” “us,” or “our”).

By requesting, purchasing, scheduling, or using our services, you acknowledge and agree to these Terms.

2. NON-ATTORNEY / TEXAS NOTARY DISCLOSURE

The Certified Society LLC is not a law firm, and its representatives are not attorneys licensed to practice law in Texas. We do not provide legal advice, determine legal rights, select legal forms or documents for clients, interpret the legal effect of documents, or represent clients before courts or government agencies.

Notarial services are performed in accordance with applicable Texas law. A Texas notary public who is not an attorney cannot provide legal advice, select a legal document or notarial certificate for a client, or advise a client regarding the legal effect of a document.

The client or signer is responsible for providing the document to be notarized and determining the document and notarial act required. The signer must personally appear when required by law and provide satisfactory identification or otherwise satisfy applicable Texas identification requirements.

3. REQUIRED NON-ATTORNEY NOTICE

I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN TEXAS AND MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.

NO SOY ABOGADA CON LICENCIA PARA EJERCER EL DERECHO EN TEXAS Y NO PUEDO DAR ASESORÍA LEGAL NI ACEPTAR HONORARIOS POR ASESORÍA LEGAL.

When notarial services are advertised in a language other than English, applicable Texas disclosure and notarial-fee requirements must also be displayed conspicuously where required.

4. IMMIGRATION-RELATED MATTERS

The Certified Society LLC does not provide immigration legal advice, determine immigration eligibility, recommend immigration benefits or strategies, select immigration forms for clients, prepare immigration documents in a manner prohibited by Texas law, or represent clients before USCIS, the Department of Homeland Security, the Department of State, immigration courts, or any other governmental authority.

Where permitted by law, The Certified Society LLC may provide independent translation, typing, copying, scanning, printing, document organization, and other purely clerical services based solely upon information and instructions supplied by the client.

Providing typing or translation services does not mean that The Certified Society LLC selected the document, determined that the document is appropriate, advised the client how to answer a legal question, or determined the client’s eligibility for an immigration benefit.

Clients who need assistance determining which immigration benefit or form to pursue, how to answer a legal question, their eligibility, or the legal consequences of information provided should consult a licensed immigration attorney or federally authorized representative.

5. APOSTILLE & AUTHENTICATION SERVICES

The Certified Society LLC provides administrative assistance with apostille, authentication, legalization, and related document-processing services.

The Certified Society LLC is a private business and is not affiliated with or endorsed by the Texas Secretary of State, U.S. Department of State, USCIS, any embassy or consulate, or any other governmental authority.

We do not guarantee that a document will be accepted, authenticated, apostilled, legalized, or accepted for its intended use by any governmental agency, foreign government, embassy, consulate, court, business, or other receiving party.

Processing times are estimates only. Government processing times, requirements, closures, requests for additional documentation, rejections, shipping delays, and other circumstances outside our control may affect completion.

The client is responsible for providing authentic, complete, accurate, and properly issued documents.

6. TRANSLATION SERVICES

Translations are prepared based on documents and information supplied by the client. Translation services are separate from legal advice.

Unless expressly agreed otherwise in writing, The Certified Society LLC does not guarantee acceptance of a translation by USCIS, courts, foreign governments, embassies, consulates, schools, employers, financial institutions, or other third parties.

Clients are responsible for reviewing names, dates, numbers, spellings, and other identifying information appearing in translations before submission.

7. DOCUMENT, LETTER, TYPING & ADMINISTRATIVE SERVICES

Where permitted by law, The Certified Society LLC may provide clerical, typing, formatting, translation, document organization, and administrative services based upon information and instructions provided by the client.

We do not independently determine which legal document a client needs or provide legal advice regarding the contents or consequences of a document.

The client is responsible for determining whether a document is appropriate for the client’s intended purpose and should consult an attorney when legal advice is necessary.

8. ITIN, EIN & BUSINESS FILING SERVICES

Administrative assistance involving ITINs, EINs, business filings, or similar matters does not constitute legal, tax, financial, or accounting advice.

The Certified Society LLC does not guarantee IRS approval, ITIN or EIN issuance, state approval, business registration approval, processing times, tax treatment, or any particular governmental or financial outcome.

Clients should consult a licensed attorney, CPA, enrolled agent, or other qualified professional when legal, accounting, or tax advice is required.

9. CLIENT INFORMATION & AUTHORIZATION

The client represents that all information and documents supplied to The Certified Society LLC are accurate, authentic, and lawfully provided.

The client represents that the client has authority to provide the documents and information submitted to us and authorizes us to use that information solely as reasonably necessary to perform the requested service.

The Certified Society LLC may rely upon information provided by the client without independently verifying its accuracy unless verification is specifically part of the purchased service.

10. CLIENT REVIEW & APPROVAL

The client is responsible for reviewing all documents for accuracy before signing, notarization, shipment, filing, or submission.

Once a client approves a document or instructs us to proceed, the client assumes responsibility for errors contained in information the client supplied or approved. Corrections or additional work requested after completion may require an additional fee.

• Names

• Dates

• Addresses

• Identification numbers

• Spellings

• Translations

• Recipient information

• Destination countries

• Mailing addresses

• Other client-provided information

11. FEES & PAYMENT

Fees are disclosed before or at the time services are ordered. Payment may be required before work begins, before an appointment, or before completed documents are released.

Government filing fees, Secretary of State fees, consular fees, courier charges, shipping charges, translation charges, travel charges, and other third-party expenses may be separate from our professional or administrative service fees unless expressly included in the quoted price.

Third-party and government fees may change without notice. Notarial acts are charged in accordance with applicable Texas law. Travel, convenience, printing, administrative, or other non-notarial charges are separate when applicable and disclosed to the client.

12. RUSH & EXPEDITED SERVICES

Rush, same-day, next-day, or expedited fees compensate The Certified Society LLC for prioritizing and expediting the portion of the service within our control.

An expedited fee does not guarantee the processing speed of a government agency, Secretary of State, U.S. Department of State, embassy, consulate, shipping carrier, or other third party.

Estimated completion dates are not guaranteed unless expressly stated otherwise in writing.

13. CANCELLATIONS & REFUNDS

Deposits, rush or expedited-service fees, travel fees already incurred, government fees, shipping charges, third-party fees, and amounts attributable to work already performed are non-refundable to the extent permitted by law.

Once work has begun, the portion of the payment attributable to work already performed is non-refundable. Once the requested service has been completed, the service fee is final, subject to applicable law.

A government or third-party denial, rejection, delay, request for additional information, change in requirements, or refusal to accept a document does not automatically entitle the client to a refund.

Nothing in this policy limits any right or remedy that cannot lawfully be waived.

14. GOVERNMENT & THIRD-PARTY DECISIONS

The Certified Society LLC does not control decisions made by government agencies or third parties, including USCIS, the IRS, Texas Secretary of State, U.S. Department of State, foreign governments, embassies, consulates, courts, county clerks, vital-records offices, educational institutions, financial institutions, shipping carriers, and other receiving authorities.

Requirements, fees, forms, procedures, and processing times may change without notice. We are not responsible for delays or additional requirements resulting from changes made by these entities after a service has been ordered.

15. SHIPPING & DELIVERY

When a client authorizes shipment through USPS, FedEx, UPS, DHL, courier, or another third-party carrier, the client acknowledges that transportation and delivery are performed by an independent third party.

The Certified Society LLC is not responsible for carrier delays, weather delays, misrouting, theft, loss, or damage occurring outside our reasonable control.

Shipping and replacement costs resulting from carrier problems may be the client’s responsibility except where otherwise required by law.

16. APPOINTMENTS, MOBILE SERVICES & CANCELLATIONS

Clients are responsible for providing an accurate appointment location and ensuring that all required signers, witnesses, identification, and documents are available at the scheduled time.

Travel fees may be non-refundable once travel has begun. Additional charges may apply for additional travel, excessive waiting time, missed appointments, rescheduling, after-hours service, parking, or other circumstances disclosed to the client.

Payment of a travel or convenience fee is separate from the statutory fee charged for the notarial act itself.

17. NO GUARANTEE OF OUTCOME

Clients pay The Certified Society LLC for the service performed—not for a guaranteed governmental or third-party outcome.

We do not guarantee approval, acceptance, certification, authentication, legalization, issuance, processing time, delivery date, or any other particular result unless an express written guarantee is provided.

18. NOTARY RECORDS

Notarial records will be created, maintained, retained, and disclosed as required by applicable Texas law.

Nothing in these Terms should be interpreted as making a Texas notary record confidential when Texas law requires disclosure.

19. PRIVACY & ELECTRONIC COMMUNICATIONS

We use reasonable administrative and technological measures to protect client information.

By providing a telephone number or email address in connection with a requested service, the client authorizes The Certified Society LLC to communicate regarding that service through telephone, text message, or email as permitted by applicable law.

Clients acknowledge that ordinary email and text messaging may carry privacy and security risks.

Information may be disclosed when required by law, subpoena, court order, governmental requirement, or when reasonably necessary to perform a service authorized by the client.

20. ABANDONED OR UNCLAIMED DOCUMENTS

Clients are responsible for responding to communications and collecting completed documents in a timely manner.

Documents that remain unclaimed after reasonable attempts to contact the client may be securely stored, returned, or destroyed in accordance with applicable law and our document-retention practices.

Additional shipping, storage, reproduction, or reprocessing fees may apply when appropriate and disclosed to the client.

21. CHARGEBACKS & PAYMENT DISPUTES

Clients should contact The Certified Society LLC promptly if they believe a billing error has occurred so that we have an opportunity to investigate and resolve the matter.

Initiating a payment dispute does not alter the client’s responsibility for valid charges for services actually authorized and performed.

Nothing in these Terms waives any payment-dispute or consumer right that cannot legally be waived.

22. PROHIBITED USES & RIGHT TO REFUSE SERVICE

Clients may not use our services to facilitate fraud, forgery, identity theft, misrepresentation, submission of knowingly false information, creation or use of fraudulent documents, or any unlawful activity.

The Certified Society LLC reserves the right to refuse, suspend, or discontinue a service when we reasonably believe the requested service may violate applicable law, notarial requirements, government rules, ethical obligations, or company policies.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, The Certified Society LLC shall not be liable for indirect, incidental, special, exemplary, or consequential damages arising from circumstances outside our reasonable control, including government decisions or delays, third-party actions, carrier delays, or inaccurate information supplied or approved by the client.

To the maximum extent permitted by applicable law, liability arising from a particular paid service shall not exceed the amount paid to The Certified Society LLC for that specific service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

24. INDEMNIFICATION

To the extent permitted by applicable law, the client agrees to indemnify and hold harmless The Certified Society LLC and its owners, employees, contractors, and representatives from third-party claims, damages, or expenses resulting from fraudulent, unlawful, unauthorized, or materially inaccurate information or documents supplied by the client or from the client’s misuse of our services.

This provision does not require a client to indemnify The Certified Society LLC for liability that cannot legally be shifted to the client.

25. FORCE MAJEURE

The Certified Society LLC will not be responsible for delays or inability to perform caused by circumstances outside our reasonable control, including severe weather, natural disasters, government closures, governmental delays, power or internet outages, carrier disruptions, emergencies, civil disturbances, or similar events.

26. WEBSITE INFORMATION

Information contained on this website is provided for general informational purposes and does not constitute legal, tax, accounting, or financial advice.

Website descriptions, prices, estimated processing times, government requirements, and service availability may be updated from time to time. Government requirements should be independently confirmed when necessary.

27. INTELLECTUAL PROPERTY

Original website content, branding, logos, graphics, photographs, written materials, templates, and other original materials owned by The Certified Society LLC are protected by applicable intellectual-property laws.

They may not be reproduced, distributed, sold, republished, or commercially used without authorization except as permitted by law.

28. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.

29. NO WAIVER

Failure by The Certified Society LLC to enforce any provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision or another provision in the future.

30. ENTIRE AGREEMENT

These Terms, together with any applicable written service agreement, invoice, order confirmation, privacy notice, refund policy, or service-specific disclosure, constitute the agreement between the client and The Certified Society LLC concerning the purchased service.

If a separate written agreement expressly conflicts with these Terms, the terms of the separate agreement will control for that specific service to the extent stated in that agreement.

31. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute shall be brought in a court of competent jurisdiction as permitted by applicable law.

32. MODIFICATIONS

The Certified Society LLC may update these Terms periodically to reflect changes in services, business practices, or applicable law.

The version in effect when a client purchases or requests a service will apply to that transaction unless otherwise agreed in writing.

33. ACCEPTANCE OF TERMS

By purchasing, scheduling, requesting, or using a service, the client acknowledges that the client has had an opportunity to review these Terms.

When an electronic checkbox, signature, payment authorization, or other acceptance mechanism is presented, completing that action constitutes the client’s acknowledgment and acceptance of the applicable Terms.
