IMPORTANT TEXAS NOTARY PUBLIC NOTICE

 

The Certified Society LLC provides notary public services through a commissioned Texas Notary Public.  

 

A Texas Notary Public is not authorized to practice law solely by virtue of holding a notary commission.  

 

I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN TEXAS AND MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.

A Texas notary who is not an attorney cannot select legal documents for clients, select a notarial certificate on behalf of a client, interpret the legal effect of documents, or provide legal advice.  

 

If you are uncertain which document, notarial certificate, or legal procedure you require, you should consult a licensed attorney.  

 

Texas SOS specifically confirms that a non-attorney notary cannot choose the type of notarial certificate for a client because doing so constitutes the practice of law.  

 

NOTARY FEES Notarial fees are charged in accordance with the maximum fees permitted under applicable Texas law.  

 

Any separate travel, convenience, after-hours, administrative, printing, document-handling, or other non-notarial service charge is separate from the fee charged for the notarial act and will be disclosed to the client.  

 

IMPORTANT: On this section of your actual website, I want you to insert your complete current Texas statutory notary fee schedule, rather than me giving you a shortened list that might omit one of the permitted acts. Texas specifically requires the foreign-language advertising notice to include the fees a notary may charge.  

 

IDENTIFICATION & PERSONAL APPEARANCE

 

Signers must personally appear before the notary when required by Texas law and satisfy applicable identification requirements.  

 

A notary may refuse to perform a notarization when legal requirements are not satisfied or when the notary has reasonable concerns regarding identity, willingness, awareness, document completeness, fraud, or legality.  

 

NO LEGAL ADVICE

 

Notarization does not:  

• Make a document legally valid

• Confirm that a document is legally sufficient

• Confirm that statements within a document are true

• Establish that a document will be accepted by a court, government agency, foreign government, embassy, consulate, or other receiving party

• Constitute legal advice  

 

The notary’s role is limited to performing the authorized notarial act.  

 

FOREIGN-LANGUAGE ADVERTISING

 

The Certified Society LLC complies with Texas requirements applicable to advertising notarial services in languages other than English.  

 

The Certified Society LLC does not use the terms “notario” or “notario público” to advertise Texas notary services.  

 

Texas SOS expressly prohibits those terms in notary advertising and requires the non-attorney disclosure when notary services are advertised in another language.
